As part of the flagship 6th UNCITRAL Asia Pacific Judicial Summit held on 1 December 2025, Edward Liu, Partner at Haiwen Hong Kong, joined a distinguished panel on “Digital Transformation in Transport – The Draft United Nations Convention on Negotiable Cargo Documents (NCD Convention)”. The panel brought together leading voices from the judiciary, academia, and international organisations to explore the pivotal role of law in advancing paperless trade.

Mr Liu highlighted the significance of Chapter Four of the Convention, which for the first time confers functional equivalence between electronic negotiable cargo documents (eNCDs) and their paper counterparts — a major milestone for trade digitalisation. He further observed that China’s newly amended Maritime Law (effective 1 May 2026), together with Hong Kong’s common law system, offers a strong dual foundation to support the Convention’s adoption.

“The NCD Convention bridges long-standing legal gaps across transport modes and establishes a unified digital framework for title transfer,” noted Mr Liu. “With the Convention now formally adopted by the 80th United Nations General Assembly and set to enter into force, a new chapter for global trade law begins — one in which Hong Kong will play a unique bridging role, offering Mainland enterprises certainty and internationally aligned legal support.”
该《公约》由中国主导推动，历经六年多边谈判，于2025年12月15日正式获联合国大会通过，被视为推动全球贸易便利化、降低物流成本及支持中小企业“走出去”的重要法律成果。
Led by China and concluded after six years of multilateral negotiation, the Convention was formally adopted by the United Nations General Assembly on 15 December 2025. It is widely regarded as a landmark achievement in facilitating trade, lowering logistics costs, and supporting SMEs in expanding internationally.

Mr Liu also attended the Second Meeting of the Expert Committee of the Hong Kong International Legal Talents Training Academy, marking the Academy’s first anniversary. The Committee, comprising 17 distinguished legal experts from international, Mainland, and Hong Kong backgrounds, engaged in in-depth discussions on core topics such as cross-border dispute resolution, international commercial law, and Belt and Road legal capacity building.
