近日，海问数据合规业务组受国际知名法律评级机构The Legal 500邀请，独家撰写《比较法国别指南：人工智能》（The Legal 500 Country Comparative Guides: Artificial Intelligence）中国专章。本次中国专章指南由海问合伙人杨建媛、律师李天烁、实习生赵雅泽共同执笔。

本系列指南由The Legal 500发起，覆盖众多法律业务领域。其中人工智能领域系今年首创，旨在邀请全球在人工智能领域深耕的法律专业人士，通过问答的形式，从立法、执法、司法三重维度，针对在各法域投资、开发、应用人工智能所涉及的数据合规、知识产权、侵权责任等各方面法律问题进行全景式介绍。
本指南结合《生成式人工智能服务管理暂行办法》（“《生成式AI暂行办法》”）等最新法律法规要求，全面覆盖人工智能领域的核心法律议题，以期为读者提供中国人工智能治理的全域视景，包括但不限于：

  • 制度框架：介绍了“人工智能”的法律定义和相关宏观政策，立足于正在由“急用先行”向“体系建构”过渡的中国人工智能法律体系。

  • 责任分配：就人工智能系统致害的责任分配这一经典问题，系统论述了中国现行法中的相关民事及刑事规则，同时涉及举证责任分配、责任保险等相关制度。

  • 知识产权：从规则及实践两个角度，对AIGC可版权性、人工智能作为发明人的适格性等前沿问题予以回答。

  • 监管实践：介绍了人工智能领域主要监管部门及其分工，以及人工智能领域的行政监管、司法裁判的整体情况及典型案例。

  • 难点聚焦：针对人工智能系统的隐私风险、利用个人数据训练人工智能等数据合规焦点问题予以回答，并专门分析了工作场所使用人工智能系统的主要合规风险项。

  • 趋势前瞻：对中国人工智能领域的基础性法律规范——《人工智能法》——的立法作出展望，并预测人工智能为中国法律行业带来的风险与挑战。

当前，中国的人工智能规则体系、监管实践正随着技术发展快速迭代，备受关注的《生成式AI暂行办法》已于2023年8月15日生效实施（新规解读参见《海问·观察︱生成式AI新规亮点：有分寸、重实际、留空间、促发展》），相关的监管行动正在循序推进，例如，近期已有多款生成式AI应用因合规问题在苹果中国区应用商店下架。
在“包容审慎”“分类分级监管”的监管原则指导下，通晓相关规则体系是提供人工智能服务企业的必修课。适时有效的合规措施将转化为生产力和竞争优势，最终助推企业成为行业龙头。
