Recently, the International Chamber of Commerce (ICC) released its preliminary dispute resolution statistics for 2024. The data shows that among the 831 arbitration cases initiated under the ICC Arbitration Rules, 17 cases involved parties applying for an emergency arbitration procedure to seek injunctive relief.

Among these 17 emergency arbitration cases, Haiwen & Partners LLP successfully represented a leading global gaming company in defending against an emergency injunction application filed by another internationally renowned game developer. The opposing party alleged intellectual property infringement in the development and release of the client’s game and sought to block its further launch and operation through emergency arbitration proceedings.

The analysis covered New York law (the governing law) while incorporating perspectives from Hong Kong and English law, offering a robust cross-jurisdictional legal assessment.
