Haiwen Labor Law Team Publishes Insights on Judicial Interpretation II in China Law & Practice

近日,海问律师事务所吴琼律师和刘宇翔律师受邀在《中国法律商务》(China Law & Practice)发表关于《最高人民法院关于审理劳动争议案件适用法律问题的解释(二)》(“《司法解释二》”)的深度解读,团队成员陈青青律师、庄晓怡律师参与撰写。该期刊隶属于国际知名法律出版机构ALM集团,长期致力于为大型跨国公司、政府组织以及律师事务所提供关于中国法律发展的最新资讯。

Recently, Wu Qiong and Liu Yuxiang, Partners at Haiwen & Partners’ Labor Law team, were invited to contribute an in-depth commentary on the Interpretation on Issues of Application of the Law in the Trial of Labor Dispute Cases (II) (“Interpretation II”) issued by the Supreme People’s Court to China Law & Practice. Associates Chen Qingqing and Zhuang Xiaoyi assisted in the drafting. China Law & Practice is a well-known legal publication under the internationally renowned ALM Group, which has been dedicated to providing multinational companies, government organizations, and top law firms with the latest updates on China’s legal developments.

《司法解释二》由最高人民法院于2025年7月31日发布,是对劳动争议相关法律规定和实践的重要解释,对企业用工行为和劳动管理有深远影响。本篇文章总结并评述了《司法解释二》中关于劳动合同管理和续签的条款,分析讨论了竞业限制义务、特殊待遇所产生的服务期、违法解除的继续履行后果的相关规则,不仅从法律技术层面提供了清晰解读,也结合实务对用人单位的合规管理提出了策略性建议。

Issued by the Supreme People’s Court on 31 July 2025, Interpretation II provides important clarifications on laws and practices relating to employment disputes, with far-reaching implications for corporate employment practices and labor management. Our article summarizes and evaluates the provisions relating to the employment contract management and renewal, analyzes and discusses rules on non-compete obligations, service periods arising from special benefits, and the reinstatement in case of wrongful termination in Interpretation II. We not only provided technical clarity on the legal rules, but also provides strategic insight and compliance management recommendations for employers.
