Haiwen & Partners is pleased to announce that Edward Liu Partner at the Hong Kong office, has published a feature article entitled “Rethinking the Right of Appeal on Error of Law in Arbitration: A Timely Reform for Hong Kong” in the January 2026 issue of Hong Kong Lawyer, the official journal of the Law Society of Hong Kong.


该文章深入分析香港现行《仲裁条例》( 609 )下就法律问题提出上诉的制度安排,并探讨在现行高度限制性的制度下,是否有必要进行审慎而有针对性的改革。文章重点讨论仲裁终局性与法律正确性之间的张力、《仲裁条例》附表2所规定的选择性上诉机制的实际运作情况,以及香港法院在批予上诉许可方面一贯采取的严格门坎。文章同时参考其他主要普通法司法管辖区的最新发展,包括英国《2025 年仲裁法》及新加坡就仲裁上诉机制展开的政策检讨,以说明国际仲裁实务中的新趋势。


The article examines Hong Kong’s current framework for appeals on questions of law under the Arbitration Ordinance (Cap. 609) and considers whether carefully calibrated reform is timely and desirable. It analyses the tension between arbitral finality and legal correctness, the operation of the opt-in appeal mechanism under Schedule 2, and the Hong Kong courts’ consistently high threshold for granting leave to appeal. The article also draws on comparative developments in other leading common law jurisdictions, including the United Kingdom’s Arbitration Act 2025 and Singapore’s ongoing review of appellate mechanisms in arbitration, to highlight emerging international trends.

该文章的发表正值香港仲裁法律改革的重要时刻。2025917日,行政长官在《施政报告》中宣布,政府将研究是否有需要修订《仲裁条例》。其后,律政司于20251030日成立仲裁法律改革工作小组,并于20251117日举行首次会议,就香港仲裁的立法框架进行检讨并考虑可能的修订方向。刘洋律师为该工作小组成员之一。


The publication comes at a pivotal moment for arbitration law reform in Hong Kong. On 17 September 2025, the Chief Executive announced in the Policy Address that the Government would study the need to amend the Arbitration Ordinance. This was followed by the establishment of the Working Group on Arbitration Law Reform by the Department of Justice on 30 October 2025, which held its first meeting on 17 November 2025 to review the legislative framework for arbitration and consider possible amendments. Edward Liu is a member of the Working Group.

The article examines Hong Kong’s current framework for appeals on questions of law under the Arbitration Ordinance (Cap. 609) and considers whether carefully calibrated reform is timely and desirable.
