Haiwen & Partners is pleased to have participated in the 3rd Joint Legal Workshop 2026, co-organised by the Department of Justice of the Hong Kong Special Administrative Region and the Ministry of Justice of the Republic of Korea, and held in Hong Kong on 5 August 2026. Edward Liu, Partner of Haiwen’s Hong Kong office, served as moderator of the panel discussion.

 

本次工作坊汇聚来自中国香港及韩国的高级官员、资深法律执业人士及争议解决专家,从两地视角共同探讨仲裁与调解领域的最新发展。活动吸引逾170名人士参加,充分体现中国香港与韩国之间紧密的法律及经贸联系,以及高效跨境争议解决机制在区域商业活动中的日益重要地位。

 

The Workshop brought together senior officials, leading practitioners and dispute resolution specialists from Hong Kong and Korea to discuss the latest developments in arbitration and mediation from the perspectives of both jurisdictions. Attended by more than 170 participants, the event reflected the depth of legal and commercial engagement between Hong Kong and Korea and the growing importance of effective cross-border dispute resolution in regional commerce.

 

工作坊由香港特别行政区律政司司长林定国资深大律师及大韩民国法务部国际法律咨询处处长金玟贞女士致欢迎辞,为活动揭开序幕。

 

The Workshop opened with welcome remarks by Mr Paul Lam SC, Secretary for Justice of the Hong Kong SAR, and Ms Kim Min-jung, Director of the International Legal Advisory Division of the Ministry of Justice of the Republic of Korea.

 在专题讨论环节中,刘洋律师与多位杰出讲者共同就跨境商业中的核心争议解决议题展开深入交流。与会嘉宾包括香港调解资历评审协会主席姚定国教授、香港国际仲裁中心秘书长刘煦婷律师,以及两位在香港执业的韩国裔法律专业人士。讨论内容涵盖调解角色的持续演进、香港仲裁制度的最新发展、香港与韩国法院对仲裁的比较司法取态,以及与裁决执行相关的策略性考量。与会者亦重点讨论了在合同订立阶段及早规划争议解决机制的重要性,尤其是在交易涉及多法域当事人、资产分布或执行风险时,更见关键。

 

Alongside distinguished panellists including Prof TK Iu, MH, Chairman of the Hong Kong Mediation Accreditation Association Limited, and Ms Joanne Lau, Secretary-General of the Hong Kong International Arbitration Centre, as well as two Korean practitioners based in Hong Kong, the panel examined issues central to cross-border commerce. These included the evolving role of mediation, recent developments in Hong Kong’s arbitration framework, comparative judicial approaches to arbitration in Hong Kong and Korea, and strategic considerations relating to enforcement. The discussion also highlighted the importance of addressing dispute resolution strategy at the contract stage, particularly where parties, assets or enforcement risks span multiple jurisdictions.

 

本次工作坊举行之际,正值香港与韩国经贸联系持续深化。正如律政司司长在致辞中指出,韩国于2025年为香港第七大贸易伙伴,两地全年商品贸易总额达3,140亿港元。随着双边贸易及投资往来不断扩大,市场对兼具公信力、效率及国际执行力的争议解决机制的需求亦持续上升。

 

The Workshop took place against a backdrop of deepening commercial ties between Hong Kong and Korea. As noted in the Secretary for Justice’s remarks, Korea was Hong Kong’s seventh largest trading partner in 2025, with bilateral goods trade reaching HK$314 billion. As trade and investment flows continue to expand, so too does demand for dispute resolution mechanisms that are credible, efficient and internationally effective.

 

本次活动亦进一步彰显香港持续巩固其国际法律及争议解决中心地位的坚定承诺,包括持续检视仲裁制度,以及推进调解制度改革。

 

The event also underscored Hong Kong’s continuing commitment to maintaining its position as a leading international legal and dispute resolution centre, including through ongoing review of its arbitration framework and proposed reforms to its mediation regime.

 

谈及本次工作坊,刘洋律师表示:能够主持这场围绕香港与韩国仲裁及调解发展而展开的重要对话,我深感荣幸。随着亚洲跨境商业活动持续深化,市场参与者所关注的,已不仅是法律框架本身的完备性,也包括裁决的可执行性、程序效率,以及争议解决安排在商业上的前瞻性与合理性。此类持续交流,对于增进相互理解,并推动区域内争议解决实践不断提升,具有重要意义。

 

Commenting on the Workshop, Edward Liu said: “It was a privilege to moderate this important dialogue between Hong Kong and Korea on the development of arbitration and mediation. As cross-border business activity across Asia continues to deepen, parties are increasingly focused not only on the quality of legal frameworks, but also on enforceability, procedural efficiency and commercially sound dispute planning. Continued engagement of this kind is important to strengthening mutual understanding and advancing effective dispute resolution practices across the region.”
